Submission Agreement to The 3AM Confessional Podcast

Thank you for your interest in sharing your story with the The 3AM Confessional community. Before you submit your story, secret, or any other content (collectively, your "Submission"), please carefully read and agree to the following terms and conditions.

By clicking "I Agree" and providing your Submission, you acknowledge and agree to the following:

1. Grant of Rights: You grant The 3AM Confessional podcast, its producers, hosts, and affiliates (collectively, "us") a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, edit, adapt, modify, publish, distribute, publicly perform and display, and create derivative works from your Submission in any and all media or formats, whether now known or hereafter developed, for any purpose, including commercial purposes.

2. No Obligation to Use: We are not obligated to use your Submission. We may review, screen, and select submissions at our sole discretion and may choose not to feature your story for any reason.

3. Right to Edit: You acknowledge that we have the right to edit, condense, or alter your Submission for clarity, length, and content, and to ensure anonymity. We may also add commentary, music, or other audio elements.

4. Anonymity: We will make a reasonable effort to maintain your anonymity if you request it. However, you are solely responsible for removing any and all personally identifying information from your Submission (e.g., real names, specific locations, company names). You acknowledge that we cannot guarantee absolute anonymity, and you release us from any liability should your identity be discovered.

5. No Compensation: You agree that you are not entitled to any compensation, credit, or attribution of any kind, now or in the future, for your Submission. The opportunity to have your story shared is the sole consideration for the rights you are granting.

6. Your Representations (Your Promises to Us): You represent and warrant that:

• You are at least 18 years of age or have the consent of a parent or legal guardian.

• Your Submission is your own original work, and you have the right to grant us these permissions.

• To the best of your knowledge, your Submission is truthful and does not violate the rights of any third party, including copyright, trademark, privacy, or publicity rights.

• Your Submission is not defamatory, libelous, obscene, or hateful.

7. Waiver and Release: You hereby waive any and all claims you may have against us and release us from any liability in connection with our use, editing, or publication of your Submission. You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from a breach of your representations in this agreement.

8. Acknowledgment Regarding Illegal Activities: You acknowledge and agree that we are not lawyers, therapists, or clergy, and that submissions to this podcast are not protected by any legal privilege. While our intent is to share stories for entertainment, we take the safety of our community and the public seriously. We reserve the right, but do not assume the obligation, to report to law enforcement authorities any submission that we believe, in our sole discretion, contains a credible threat of harm to oneself or others, or involves the ongoing abuse or exploitation of a minor.

By submitting your story, you confirm that you have read, understood, and agree to be bound by all the terms of this Submission Agreement.
